Most federal benefit programs require citizenship or qualified immigrant status. However, several critical programs are available regardless of immigration status — including emergency care, community health centers, and benefits for U.S.-born children. State programs vary significantly.
What's available regardless of immigration status
- Emergency Medicaid: Covers emergency medical conditions including labor and delivery in all states. No immigration check for emergency care.
- Federally Qualified Health Centers (FQHCs): Serve all patients regardless of immigration status on a sliding-scale fee basis — often $0 for very low income. Find the nearest one at findahealthcenter.hrsa.gov.
- Free and charitable clinics: No immigration check. Find clinics at nafcclinics.org.
- Food banks and pantries: No documentation required. Find one at Feeding America.
- Public K–12 education: All children, regardless of immigration status, have the right to public education (Plyler v. Doe).
- WIC for U.S.-born children: Children born in the U.S. are citizens and can receive WIC even if parents are undocumented. Applying for children does not require providing the parents' immigration status.
- Free/reduced school meals: Available to all children regardless of parents' immigration status.
Benefits for U.S.-citizen children of undocumented parents
Children born in the U.S. are citizens and may qualify for:
- SNAP (parents do not need to provide their own immigration status)
- Medicaid and CHIP (coverage for the child, not the parent)
- WIC (for children under 5)
- SSI (if the child has a qualifying disability)

Several states have expanded coverage using state (not federal) funds:
- California (Medi-Cal): Full-scope Medi-Cal for all income-eligible residents regardless of immigration status and age as of 2024.
- New York: Coverage for children and pregnant women regardless of status; adults in some coverage programs.
- Colorado: State-funded health coverage for low-income residents regardless of immigration status.

Public charge: what you should know
The public charge rule considers whether an immigrant is likely to become primarily dependent on the government. Under current rules (as of 2026), the benefits considered in public charge assessments are limited to:
- SSI
- TANF
- Medicaid (for adults — not children, pregnancy-related, or emergency care)
- Section 8 vouchers
- Public housing
SNAP, CHIP, WIC, school meals, and emergency Medicaid are NOT included in public charge assessments. Consult an immigration attorney before making decisions based on public charge concerns.
Common questions
Can undocumented immigrants get SNAP?
Not federal SNAP. But U.S.-citizen children in the household can. California has a state-funded CalFresh program for mixed-status households. Food banks and pantries are available to everyone, no documentation needed.
Can undocumented immigrants get Medicaid?
Emergency Medicaid is available in all states. Several states (CA, NY, CO, and others) have expanded state-funded coverage to undocumented residents. FQHCs provide sliding-scale care regardless of status.
Does applying for benefits for my children affect my immigration case?
